Privacy Policy

Bingenuity respects your privacy. This Privacy Policy explains how we collect, use, share, and protect information when you use the Bingenuity platform (the “Service”). By using the Service, you agree to the practices described in this policy.

1. Information We Collect

Information You Provide

When you create an account or use the Service, you may provide the following information:

  • Email address
  • Display name
  • Profile image
  • Phone number and carrier information (if SMS notifications are enabled)
  • Watchlists, binge tracking data, and recommendations
  • Written reviews and ratings
  • Private messages sent through the platform

Information Collected Automatically

When you access the Service, we automatically collect certain technical and usage information, including:

  • IP address
  • Device type and operating system
  • Browser type and version
  • Progressive Web App (PWA) installation status
  • Login timestamps and session duration
  • Usage data such as pages visited, features used, and interactions
  • Cookies and session identifiers (see our Cookie Policy for details)

Information from Third-Party Sources

Bingenuity displays entertainment metadata sourced from third-party APIs, including TMDB (The Movie Database), to provide show and movie information. This metadata includes titles, descriptions, artwork, cast information, and streaming platform availability. This data is not personal information and remains the property of its respective owners.

2. How We Use Information

We use the information we collect for the following purposes:

  • To operate, maintain, and improve the Service.
  • To create and manage your account.
  • To enable messaging, connections, and shared lists between users.
  • To send SMS notifications when opted in by the user, using email-to-SMS carrier gateways.
  • To display advertising and affiliate links (see Section 6 for details).
  • To analyze usage patterns and improve platform performance and security.
  • To enforce our Terms of Service and protect against misuse.
  • To respond to user inquiries, feedback, and support requests.

We do not sell your personal information.

3. Artificial Intelligence Processing

Bingenuity provides AI-powered chatbot functionality to assist with entertainment discovery. The chatbot is powered by third-party AI services, including Google Gemini and Google Search APIs.

When you interact with the chatbot, your prompts and relevant context are sent to Google’s Gemini API for processing. The following safeguards apply:

  • AI operates on a session-based model only. Chat history is not stored after the session ends.
  • Conversations are not used to train AI models. Google’s API terms prohibit the use of API data for model training purposes.
  • The AI does not access personal account data beyond what is necessary to respond to your query within the active session.
  • AI-generated responses may be inaccurate, incomplete, or outdated. Bingenuity does not guarantee the accuracy of AI output.

If Bingenuity adds or changes AI service providers in the future, this policy will be updated accordingly.

4. Data Sharing & Third Parties

Bingenuity does not sell your personal information. We may share limited data with the following categories of third parties:

Service Providers

  • TMDB (The Movie Database): We use TMDB’s API to retrieve entertainment metadata. No personal user data is shared with TMDB.
  • Google Gemini API: User chatbot prompts are processed through Google’s API (see Section 3).
  • SMS Carrier Gateways: If SMS notifications are enabled, your phone number and carrier information are used to deliver notifications via email-to-SMS gateways.

Advertising Partners

Bingenuity displays advertising and affiliate links. Advertising partners may use cookies or similar tracking technologies to deliver targeted advertisements. See our Cookie Policy for more information on cookies and how to manage your preferences.

Legal and Safety Disclosures

We may disclose information if required by law, legal process, or government request, or if we believe disclosure is necessary to protect the rights, property, or safety of Bingenuity, its users, or the public.

5. Cookies & Tracking Technologies

Bingenuity uses cookies and similar technologies to operate and improve the Service. For detailed information about the cookies we use, their purposes, and how to manage your preferences, please see our Cookie Policy.

6. Advertising & Affiliate Links

Bingenuity displays advertisements and affiliate links to support the operation of the Service. This may include banner ads, sponsored content, and links to streaming platforms or retailers.

Advertising partners may use cookies, web beacons, or similar technologies to collect information about your interactions with ads. Bingenuity does not provide advertisers with direct access to your personal account information. 7. Data Retention & Backups

We retain your personal information for as long as your account is active or as needed to provide the Service. Specific retention practices include:

  • Account data (email, display name, profile image) is retained for the duration of your account and up to 30 days following account deletion.
  • Usage data and analytics are retained in aggregate form and are not linked to individual accounts after 12 months.
  • Backup data is maintained on a rolling cycle for disaster recovery purposes. Deleted content may remain temporarily in backup systems and may be restored in the event of system recovery.
  • Backup data is not actively used for user-facing features.

We may retain certain information as required by law or for legitimate business purposes such as fraud prevention and enforcement of our Terms.

8. Account Deletion

Users may delete their accounts at any time through their account settings. Upon deletion:

  • Your profile, display name, and profile image will be removed from the platform.
  • Your watchlists, binge tracking data, and ratings will be deleted.
  • Your written reviews will be anonymized (the review text may remain visible but will no longer be associated with your account).
  • Private messages you have sent will be removed from your account. Recipients may still retain copies of messages previously delivered to them.
  • Your connections and shared lists will be dissolved.

Active data will be removed from production systems within 30 days. Residual copies in backup systems will be purged in accordance with our backup retention schedule. Certain data may be retained as required for legal or operational purposes.

9. Children’s Privacy

The Service is not intended for children under the age of 13. Bingenuity does not knowingly collect personal information from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA).

If we become aware that a child under 13 has created an account or provided personal information, we will take steps to delete that account and associated data promptly. If you believe a child under 13 has provided us with personal information, please contact us.

10. California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with certain rights regarding your personal information:

Right to Know

You may request that Bingenuity disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which the information was collected, the business purpose for collecting the information, and the categories of third parties with whom the information is shared.

Right to Delete

You may request deletion of the personal information we have collected about you, subject to certain legal exceptions.

Right to Opt Out of Sale

Bingenuity does not sell personal information. If this practice changes, we will provide a “Do Not Sell My Personal Information” link and update this policy.

Right to Non-Discrimination

Bingenuity will not discriminate against you for exercising any of your CCPA rights.

To submit a request, please contact us. We will verify your identity before fulfilling any request and respond within 45 days as required by law.

11. Do Not Track

Some browsers offer a “Do Not Track” (DNT) setting that sends a signal to websites requesting that your browsing activity not be tracked. Bingenuity currently does not respond to DNT signals. Regardless of your DNT setting, we do not sell personal information and you may manage advertising preferences as described in our Cookie Policy.

12. International Users

Bingenuity is operated from the United States. If you access the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country of residence. By using the Service, you consent to the transfer of your information to the United States.

13. Security

We implement reasonable administrative, technical, and organizational safeguards to protect your information, including:

  • Encrypted connections via HTTPS/TLS for all data in transit.
  • Secure password storage using industry-standard hashing algorithms.
  • Access controls limiting internal access to personal data on a need-to-know basis.
  • Regular monitoring and maintenance of security systems.

While we take reasonable measures to protect your data, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security.

14. Updates to This Policy

Bingenuity reserves the right to update or modify this Privacy Policy at any time. Changes will be reflected by an updated effective date at the top of this document. We may notify users of material changes via email or a prominent notice on the platform. Continued use of the Service following any changes constitutes acceptance of the revised policy.
