Terms of Service

Welcome to Bingenuity (“Bingenuity,” “we,” “our,” or “us”). By accessing or using the Bingenuity platform (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms, together with our Privacy Policy, Cookie Policy, DMCA & Copyright Policy, and Accessibility Statement, constitute the entire agreement between you and Bingenuity regarding your use of the Service.
1. Eligibility
You must be at least 13 years old to use the Service. The Service is not intended for children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA). If we become aware that a user under 13 has created an account, we will take steps to delete that account promptly.
The Service is primarily intended for users located in the United States. Users outside the United States may access the Service at their own risk and are solely responsible for compliance with applicable local laws and regulations.
2. Description of Service
Bingenuity is an entertainment discovery, tracking, and recommendation platform that:
- Displays movie and television metadata sourced in part from third-party providers, including TMDB (The Movie Database).
- Provides proprietary descriptions, editorial content, and curated recommendations owned by Bingenuity.
- Allows users to create accounts, maintain watchlists, and track binge-watching progress.
- Enables users to share recommendations and messages with approved connections.
- Displays advertising and affiliate links to support the operation of the Service.
- Provides AI-powered assistance for entertainment discovery using third-party AI services.
- Displays time-based popularity rankings across major streaming platforms.
Bingenuity does not host, stream, or distribute copyrighted video content.
3. Third-Party Attributions
This product uses the TMDB API but is not endorsed or certified by TMDB. Show and movie metadata, including titles, descriptions, artwork, cast information, and streaming platform availability, is sourced from TMDB and other third-party providers. This data remains the property of its respective owners.
Third-party trademarks, logos, and service marks displayed on the platform belong to their respective owners and are used for identification purposes only.
4. Accounts
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Providing accurate and complete registration information and keeping it up to date.
You agree not to share your account credentials with any third party. If you believe your account has been compromised, you must notify Bingenuity immediately.
We may suspend or terminate accounts for violations of these Terms, to protect the platform and its users, or at our sole discretion with or without notice.
5. User Content & Messaging
User Content
Users may submit the following content through the Service:
- Profile images and display names.
- Written reviews (visible only to approved connections).
- Private messages between approved connections.
You retain ownership of your content. By submitting content to the Service, you grant Bingenuity a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, reproduce, and distribute your content solely as necessary to operate and provide the Service. This license terminates when you delete the content or your account, subject to the retention provisions described below and in our Privacy Policy.
Content Upon Account Deletion
Upon account deletion, your profile, watchlists, and binge tracking data will be removed. Written reviews will be anonymized and may remain visible without association to your account. Private messages will be removed from your interface; however, recipients may retain copies of messages previously delivered to them. For full details, see our Privacy Policy.
Messaging
Messages are stored in our systems to facilitate the messaging feature. Users may delete entire conversation threads from their interface. However:
- Deletion does not guarantee immediate removal from backup systems.
- We may retain messaging data for security, compliance, legal obligations, and system integrity.
Bingenuity does not actively monitor all private communications but reserves the right to review and remove content if violations of these Terms are discovered or reported. Users may block other users at any time. Bingenuity is not responsible for interpersonal disputes between users.
6. Prohibited Conduct
You agree not to use the Service to, including but not limited to:
- Promote or facilitate illegal activity.
- Share pirated, unauthorized, or infringing streaming links or content.
- Upload or transmit pornographic, sexually explicit, or obscene material.
- Harass, threaten, bully, or intimidate other users.
- Impersonate another person or entity.
- Scrape, crawl, reverse engineer, or use automated means to access or collect data from the Service.
- Circumvent platform protections, security measures, or access controls.
- Distribute malware, viruses, or any other malicious code through the Service.
- Create multiple accounts to evade suspensions, bans, or other enforcement actions.
- Use the AI chatbot to generate harmful, abusive, misleading, or illegal content.
Violation of these provisions may result in content removal, account suspension, or permanent termination at Bingenuity’s sole discretion.
7. Artificial Intelligence Features
Bingenuity offers AI-powered assistance using third-party AI services, including Google Gemini and Google Search APIs. AI features:
- Operate on a session basis. Chat history is not stored after the session ends.
- Do not train AI models on user conversations. Google’s API terms prohibit the use of API data for model training purposes.
- Access only data that is already permissioned between users within the active session.
- May be modified, suspended, or discontinued at any time without prior notice.
AI responses are automated and may contain inaccuracies, incomplete information, or outdated data. They are provided for informational and entertainment purposes only and should not be relied upon for professional, legal, medical, or financial advice.
Users should not input sensitive personal information—such as passwords, financial account details, or government identification numbers—into the AI chatbot. Bingenuity is not responsible for any consequences arising from the submission of sensitive information to AI features.
8. Rankings & Availability Disclaimer
“Popular Now” and trending rankings represent time-based snapshots derived from aggregation methods and third-party data sources. Rankings may change throughout the day and may not reflect real-time availability on streaming platforms.
Rankings do not constitute endorsements of any particular show, movie, or streaming platform. We do not guarantee the accuracy, completeness, or current availability of any content or platform listed.
9. Advertising, Affiliate Links & FTC Disclosure
Bingenuity displays advertisements and affiliate links to support the operation of the Service. When you click on an affiliate link and make a qualifying purchase, Bingenuity may earn a commission at no additional cost to you.
Affiliate relationships and advertising partnerships do not influence the editorial content, proprietary descriptions, or popularity rankings displayed on the platform. Advertising content is clearly distinguished from editorial content where applicable.
This disclosure is made in accordance with the Federal Trade Commission (FTC) guidelines on endorsements and testimonials. For more information on how advertising data is collected and used, see our Privacy Policy.
10. Intellectual Property
All proprietary descriptions, editorial content, curated recommendations, design elements, branding, logos, and platform software are owned by Bingenuity and are protected by applicable intellectual property laws. The proprietary content referenced in Section 2 of these Terms is the exclusive property of Bingenuity.
Unauthorized reproduction, distribution, modification, scraping, or commercial use of Bingenuity’s intellectual property is strictly prohibited without prior written consent.
Third-party trademarks, metadata, and content displayed on the platform belong to their respective owners and are used in accordance with applicable licenses and attribution requirements.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Bingenuity does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy or reliability of any content, data, or information provided through the Service, including AI-generated content, rankings, and third-party metadata.
12. Limitation of Liability
To the fullest extent permitted by law, Bingenuity and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to loss of data, loss of profits, or damages arising from reliance on AI-generated content.
Bingenuity’s total aggregate liability for any and all claims arising from or related to the Service shall not exceed the greater of: (a) one hundred dollars ($100); or (b) the total amount paid by you to Bingenuity in the twelve (12) months preceding the event giving rise to the claim (which may be $0 for free users).
13. Indemnification
You agree to indemnify, defend, and hold harmless Bingenuity and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Your use of the Service or violation of these Terms.
- User content you submit through the Service.
- Your violation of any third-party intellectual property or other rights.
- Your use of AI features, including reliance on AI-generated content.
Bingenuity will provide you with reasonable notice of any claim for which indemnification is sought and will cooperate with you in the defense of such claim.
14. Arbitration & Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules, except that disputes qualifying for small claims court may be brought in small claims court instead.
Arbitration shall be conducted on an individual basis in the United States. You and Bingenuity each waive the right to a jury trial and the right to participate in any class action, class arbitration, or representative proceeding.
Arbitration filing fees and costs shall be governed by the AAA’s fee schedule. Each party shall bear its own attorneys’ fees unless the arbitrator determines otherwise.
You may opt out of this arbitration provision within 30 days of creating your account by sending written notice via our Contact form. Your opt-out notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.
15. Termination
Either party may terminate this agreement at any time. You may terminate by deleting your account through your account settings. Bingenuity may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice.
Upon termination, your right to use the Service ceases immediately. The handling of your data upon termination is described in our Privacy Policy.
The following sections shall survive termination of these Terms: Intellectual Property (Section 10), Disclaimer of Warranties (Section 11), Limitation of Liability (Section 12), Indemnification (Section 13), Arbitration & Class Action Waiver (Section 14), Governing Law (Section 16), and any other provisions that by their nature should survive.
16. Governing Law & Severability
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Arizona, without regard to its conflict of law provisions.
For any disputes not subject to arbitration, the exclusive venue shall be the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
17. Force Majeure
Bingenuity shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government actions, power failures, internet or telecommunications failures, cyberattacks, or third-party service outages.
18. Changes to These Terms
Bingenuity reserves the right to update or modify these Terms at any time. Changes will be reflected by an updated effective date at the top of this document. We may notify users of material changes via email or a prominent notice on the platform. Continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
